Son of Salem Day Care Provider Sentenced to 22.5 Years in Prison for Sexual Assault

The 17-year-old son of a Salem Day Care provider has been sentenced to 22.5 years in prison for the Class X offense of aggravated criminal sexual assault to a 10 month girl at the day care center.

Judge Marc Kelly handed down the sentence to Justin Atteberry in Marion County Court Wednesday afternoon after hearing a victim impact statement from the girl’s mother on the ongoing impact of the assault on the girl. The defense put Atteberry’s uncle on the stand who outlined JUstin’s abuse as a young child and his lack of maturity and learning ability for his age. Atteberry also made a statement in allocution apologizing for his actions.

Assistant State’s Attorney Melissa Doran asked for the maximum 30 year sentence, while Atteberry’s attorney Jessica Koester said mitigating factors should limit the sentence to ten years.

Judge Kelly said Atteberry will have to serve 85 percent of the sentence under state law and with 13 months already served in the Marion County Jail since his arrest, he will be in the Department of Corrections for 18 years.
