Salem Man Released Without Being Charged In Connection With Risque Facebook Photo

Marion County State’s Attorney Bill Milner doesn’t feel a risque photo posted to a woman’s Facebook page meets the definition of non-consensual dissemination of private sexual images.

Salem Police had arrested 30-year-old David Huffine of East Mitchell in Salem on the felony charge last Thursday after receiving a complaint from the woman. Milner saw several problems in pursuing the case. In addition to not meeting the definition of nudity as required under the law, he said there was no way to identify the victim from the photo and there had been no comments mentioning her by name.

Milner said the law might have applied differently if the alleged victim was underage, which was not the situation.

Huffine was released from the Marion County Jail on Friday after Milner decided not to file charges.
